I’m
trying to find out what are the laws, rules, regulations for a
foreigner to buy a property or a house with red book in Vietnam.
Anybody’s done it before and would be kind enough to help me to find the
answer?

Phillip Gassy New
laws as of 2015..you can buy in new estates, but not old residences.
More details you need to ask a lawyer,as foreign ownership rules
changed.

Ellie M-Ngoc The
rules doesn't allow yourself as a foreigner to own a property
(land/house/apartment) in Vietnam under your name registration. You are
only legally allowed to own it within 50 years + extending ability.
Remove
Joey Arnold You
can rent for 50 years because the word "BUY" mean forever and ever with
no time limit: you own it forever. In VN, they let you rent, as in
borrow, like a land loan: but they call it "Buying." But it is not
buying. It is not real buying. It does not have enough ownership rights.

Charles Biron Thank you # Joey that’s what I thought too

Joey Arnold Should
we have private ownership of stuff anything, products, things we buy,
things we have, things, including property, cars, bikes, houses, land,
food, animals, stuff on our land, rain water, trees on our land,
forever?

Gary FunkGroup Moderator You are not Vietnamese. You have no rights in Vietnam.

Joey Arnold Should our property rights last only for 50 years?

Nguyen Trung No own 99 years. With your name and able to exchange

Joey Arnold Nguyen Trung no, that is not the definition of owning something: to own is to be in control of it forever

Joey Arnold Nguyen Trung, FOREVER is NOT 99 years...

Jonce Korbovski We
have been in negotiations with the government and various councils for
close to 3 years. The land our project will be built on in Vung Tau is
leased for 50 years. We will never own the land.
There are various stories and information out there. I suggest you find a reputable lawyer and the most important thing, $$$$$$$ to help you through the process.

Jonce Korbovski The amount of red tape and crap is ridiculous. But the most important thing is we're almost there.....

Dennis Bennett Is
your wife a dual citizen? If she still has Vietnamese Citizenship then
she able to buy it... One of the reasons as to why my wife has dual
citizenship is if we decide do buy real estate then we will be able to
Remove
Jonce Korbovski That's correct, our properties are all in my wife's name. So legally l don't have any ownership of them....
Remove
Joey Arnold Jonce Korbovski in quotation marks, alleged "Ownership" to say the least as that is too limited in definitions, rights, legally.

Sultan Khan Jonce Korbovski are we allowed to pass ownership to our children?
Remove
Jonce Korbovski If you're a resident yes you can.
You get a red book and everyone who lives in the house must be listed. From parents to children. But as for me I'm not in the book.

Mark Whorlow Good luck with that.......since the regulations changed back in 2015 only 15 foreigners have received a red book

Michael Chang Freehold = you own the property
Lease hold = long term rent with upfront payment.
Do not confuse leasehold as property ownership.

Jim Robinson I
would question the wisdom of seeking legal advice on FB. Find an
attorney with references from people you trust. Oh, shit. I just gave
you legal advice. Sorry.

Joey Arnold Drink
water... oh, I just gave you legal advice to drink water. Oh, so, what I
said was dumb. Because it is common sense to drink water. But some
things that are considered legal advice can be and should be common
sense as well, likewise.

Joey Arnold Gary Funk,
should the Vietnamese people, nationals, citizens, those born in
Vietnam, whom live legally and everything in Vietnam, then be allowed to
own land and to have enough, as in sufficient, as in adequate, as in
natural, organic, land ownership rights, to a high enough extent apart
from too many regulations, restrictions, laws, rules, limits, loop
holes, tax requirements, zoning requirements, and so on and so forth in
regards to how long land can be rented and/or "OWNED" in quotation marks
and everything? That is the question. It is a question about land and
about who may own the land, be it individuals, cities, states, nations,
the federal government, the state government, the province, and so on.
Some might say the government owns the land. Some might say all the
citizens of the place owns the land together. Some seem not to believe
in individual private property rights and ownership in an absolute and
eternal level and extent.
